Timeshare company sent me new mortgage paperwork.?
I purchased a timeshare in June 2007. In May 2008 I "upgraded" however I signed in NYC for South Carolina timeshare and I live in Wisconsin. Although I signed a promissory note and sale agreement, the Mortgage wasn't recordable and so they want me to re-sign. I don't want this timeshare, first because I can't afford it and second, not feeling comfortable with this type of issue... can they hold me to the payments??
Recording has nothing to do with duties under signed promissory notes. You may owe the money but it is doubtful they can hold you to your payments. Let them foreclose...
I have no reason why the original note was not recordable but you might want to keep this as an argument should they seek to enforce your note.
Basically, you have changed your mind and do not want this time share. Let them worry about it. Ask for any downpayment to be returned. (Do not expect it) Be aggressive and not one bit defensive. It was their error.
And time was critical when they took your money... You might claim you have no knowledge if their delay has cost you any losses or claims.
Relax and do not worry! They likely know not to venture into Wisconsin courts.
